April, 2002 Decree Law Nr. 16.939 adopting the 8th Edition of the International Classification of Products and Services, Nice Agreement - Trademarks. With some delay Paraguay has now adopted the above-mentioned Edition on April 19 - 2002. The cited Decree Law is in force since such date. However, this Decree Law does not clarify yet the criteria that Paraguay will take as far as the issue of applications already filed before April 19 - 2002. The legal instrument does not clarify either, which criteria will be applied to the issue of renewals. Paraguay has been the last country within Mercosur (Paraguay, Argentina, Brazil, Uruguay) to adopt such Edition. In fact, Uruguay is the only country within Mercosur that is a member of the Nice Agreement. Therefore, Paraguay did not have the legal obligation as such, to have the 8th Edition become effective on January 1 - 2002. Paraguay has always been adopting the last Editions by internal resolutions. The Industrial Property Office is expected to issue a formal resolution in the near future establishing the different criteria to be applied to the above-mentioned topics and any others, which are at stake given the entry into force on April 19 - 2002 of the cited Edition. In sum, this new Decree Law just sets into force the 8th Edition, but does not establish any cited criteria at all, which are also very necessary for a serious and homogeneous application of the new Edition in several key aspects.
